Beringer Great Steak Challenge Contest Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCE OF WINNING.
Eligibility: The Beringer Great Steak Challenge Contest (the “Contest”) is open to legal residents of the United States and the District of Columbia (excluding the state of CA) who are 21 years of age or older as of the date of entry. Contest is void in CA and where prohibited or restricted by law. Employees, officers, and directors of Treasury Wine Estates Americas Company (“Sponsor”), advertising and promotional agencies involved in the Contest, state alcohol beverage commissions, alcoholic beverage distributors and retailers, and their respective parent companies, subsidiaries, and affiliates, and their immediate family members (spouse, parent(s), sibling(s), and/or children) and/or members of the same household are not eligible to participate in this Contest. The judges of the Contest and their immediate family members and/or members of the same household and persons who derive more than 75% of their total income from their employment as a food professional (preparing and cooking food in a professional environment, such as a restaurant, hotel, food truck, catering, etc.) within the calendar year are also not eligible. By entering, you agree to these Official Rules and the decisions of the judges, which are final and binding in all respects. All applicable federal, state and local laws and regulations apply.
To Enter: Visit www.GreatSteakChallenge.com between 12:00:00 AM Eastern Time (“ET”) on 4/1/11 and 11:59:59 PM ET on 7/14/11 (“Promotion Period”), fully complete the online entry form, and follow the directions provided to submit your original recipe. All entries must: 1) Include an original recipe (100 words or less) using beef steak in English; 2) Recipe may (but are not required to) contain any of the following: toppings (mushrooms, blue cheese, etc.), spreads (tapenades and pestos), sauces (barbecues, bearnaise), spices and garnishes; 3) Recipe must be completely preparable within thirty (30) minutes including cooking time; 4) Steaks must be prepared on a standard outdoor grill. Use of additional cookware on the grill, such as pots, pans and other grill-ready equipment, is permitted, but all additional equipment must be noted on the entry form in the cooking instructions. The heat level and cooking time should be noted for the type of grill you use at home. The use of small food preparation appliances such as blenders or food processors is allowed, but also needs to be noted on the entry form; 5) Each entry must include a recommended wine pairing from the Beringer Founders’ Estate portfolio that best compliments your original steak recipe. Contestants may select from any of the following Beringer Founders’ Estate wines: Pinot Grigio, Chardonnay, Riesling, Sauvignon Blanc, Pinot Noir, Merlot, Syrah, Cabernet Sauvignon, and Zinfandel. Go to www.greatsteakchallenge.com for tips and advice on wine and food pairing; 6) Each recipe must prepare for six (6) servings and must include the name of the recipe, readily available ingredients in standard U.S. measurements, and step-by-step cooking instructions including timing for any cooked components; 7) Entry must be the original recipe of the entrant; 8) Recipe must not have won previous awards in any this or any other competitions; 9) Not have been previously published; 10) Not infringe on any third-party rights; and 11) Be suitable for publication. Recipes that require the use of conventional ovens, microwave ovens, or other cooking appliances not mentioned above as being permitted will be disqualified.
In order to be entered into the Contest, contestants must comply with registration instructions. The entry must be complete and meet all criteria set forth in these Official Rules to be eligible. All entries become the property of the Sponsor and will not be returned. Limit one (1) entry per person for the duration of the Promotion Period. The name of the “authorized account holder” associated with any given email address will be deemed to be the entrant and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, an online service provider, or another organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor. Sponsor is not responsible for lost, incomplete, late, garbled, damaged, or misdirected entries or recipes, email messages; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server or other connections including those through www.GreatSteakChallenge.com; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in this Contest; printing or other errors appearing within these Official Rules or in any Promotion-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic or otherwise; or the processing or judging of entries or recipes or any injuries or damages resulting from preparation of any recipe by entrant or any third party. The use of script, macro, bot, automated entry or similar devices as specifically set forth above, is prohibited and entries through such prohibited devices are void. By entering this Contest, entrants give their express permission to be contacted by Sponsor by telephone, email and/or postal mail for promotional purposes only.
Semi-Finalist Determination: Based on the criteria outlined below, thirty (30) Semi-Finalists will be determined on or about 7/25/11 from among all eligible entries received throughout the Promotion Period. A panel of qualified independent judges selected by Sponsor, whose decisions will be final and binding in all matters relating to this Contest, will judge each recipe based on the following criteria:
50% Perceived Taste and 50% Simplicity.
- PERCEIVED TASTE: Does the recipe sound appealing??
- SIMPLICITY: Could anyone create this food by following the recipe?
In the event of a tie, the recipes of such tied entries will be re-judged based on the following criteria: Perceived Taste: 100%. The thirty (30) entrants with the highest total scores based on above criteria will be declared Semi-Finalists (subject to verification of eligibility and compliance with the terms of these Official Rules). Sponsor reserves the right to select fewer than thirty (30) Semi-Finalists if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.
Finalist Determination: Based on the criteria outlined below, ten (10) Finalists will be determined on or about 8/1/11 from among the thirty (30) Semi-Finalist entries. A separate panel of qualified independent judges selected by Sponsor, whose decisions will be final and binding in all matters relating to this Contest, will prepare and judge each recipe based on the following criteria:
25% Taste; 25% Wine Pairing; and 50% Simplicity.
- TASTE: Is the recipe appealing? Does it contain interesting and delightful flavor combinations?
- WINE PAIRING: Does the wine complement or enhance the meal?
- SIMPLICITY: Is this recipe capable of being created in a reasonable amount of time? Could anyone create this food by following the recipe?
In the event of a tie, the recipes of such tied entries will be re-judged based on the following criteria: Taste: 100%. The ten (10) entrants with the highest total scores based on above criteria will be declared Finalists (subject to verification of eligibility and compliance with the terms of these Official Rules). Sponsor reserves the right to select fewer than ten (10) Finalists if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Each Finalist will be contacted by telephone, mail and/or overnight mail and required to execute and return an Affidavit of Eligibility and a Release of Liability and (where legal) a Publicity Release within five (5) days of the date of issuance of notification. Noncompliance with the foregoing or with these Official Rules, or any notification delivery not being successful or being returned as non-deliverable, may result in disqualification of the potential Finalist and, at Sponsor’s discretion, the next runner-up being notified.
Grand Prize and Second, Third, and Fourth Place Prize Winner Determination:
Based on the criteria outlined below, one (1) Grand Prize, one (1) Second Place, one (1) Third Place, and one (1) Fourth Place winner will be determined on or about 10/8/11 from among the ten (10) Finalists. The ten (10) Finalists will be required to prepare their recipe in a live competition (as described below) using a gas grill and other cooking equipment provided by Sponsor, in its sole discretion. Each finalist prepared recipe will be judged by a panel of qualified independent judges selected by Sponsor, whose decisions will be final and binding in all matters relating to this Contest, based on the following criteria:
25% Originality; 25% Taste Appeal; 25% Wine Pairing; and 25% Simplicity
- ORIGINALITY: Is the dish one of a kind? Is there artistic, creative or imaginative thought around ingredient usage, cooking techniques and/or presentation? Does the Finalist demonstrate enthusiasm for the uniqueness of the dish?
- TASTE APPEAL: Is the recipe delicious? Does it contain interesting, delightful, flavor combinations? Did the plating and presentation add to the appeal of the recipe? Did the Finalist follow the recipe? Was the recipe prepared and the steak cooked with precision?
- WINE PAIRING: Does the wine pairing complement the recipe? Does the wine pairing enhance the recipe? Is the pairing creative or imaginative? Does the Finalist demonstrate enthusiasm for the wine and its pairing?
- SIMPLICITY: Was the dish completed in the allotted time? Was there an excessive amount of “secret” ingredients? Could this dish be easily replicated by following the recipe? Does it require complex techniques? Did it require rare or hard to find ingredients?
The recipe that receives the highest score will be deemed the Grand Prize winning recipe and the Finalist who submitted such recipe will be deemed the Grand Prize winner. The recipe that receives the second highest score will be deemed the Second Place winning recipe and the Finalist who submitted such recipe will be deemed the Second Place Winner. The recipe that receives the third highest score will be deemed the Third Place winning recipe and the Finalist who submitted such recipe will be deemed the Third Place Winner. And finally, the recipe that receives the fourth highest score will be deemed the Fourth Place winning recipe and the Finalist who submitted such recipe will be deemed the Fourth Place Winner. In the event of a tie for any given prize level, such tied entries will be judged by a “tie-breaking” judge based on the taste appeal criteria, as set forth above. Each winner will be notified at the event.
Sponsor may photograph, videotape, and otherwise record the competition for promotional and other purposes as designated by Sponsor (collectively, “Footage”). Footage will be owned by Sponsor who has the right, along with its designees, to use, edit, adapt, post, stream, copy, exploit, and make derivative works from such Footage and all elements embodied therein, including any names and likenesses embodied therein, in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade and other purposes.
Prizes: Thirty (30) Semi-Finalist Prizes: One (1) FlipCam which may be used by the Semi Finalist to record a biography and capture themselves preparing their recipe. Approximate Retail Value (“ARV”) is $200 each. Ten (10) Finalist Prizes: Each Finalist will receive a trip for two (2) to Beringer Vineyards in Napa, CA on dates specified by Sponsor. Trip includes round trip coach air transportation for Finalist and one (1) guest from a major U.S. gateway airport near Finalists’ residence to San Francisco, CA, rental car (Finalist or his/her travel companion must have a valid driver’s license and credit card and qualify for rental car company policies), 6-days/5-nights hotel accommodations (one (1) room, double occupancy) for two (2) near Beringer Vineyards in Napa Valley, local transportation to and from all sites, winery tours at Treasury Wine Estates’ Properties and meal vouchers for Finalist and guest (up to $150 per person, per day). ARV is $5,000 each. Finalists must be able to travel between 10/4/11 and 10/31/11. Actual value of prize may vary depending on winner’s city of departure and final itinerary. If winner does not qualify for rental car, no substitution for rental car will be provided, however, remainder of prize will be awarded. Exact travel dates, hotel and other arrangements to be determined by Sponsor. Finalist Prize winner and his/her guest must travel together on the same itineraries and are responsible for obtaining any/all necessary documents (including, but not limited to, valid photo I.D.) prior to departure. Finalist Prize winner’s guest must be twenty-one (21) years of age or older as of 4/1/11 and cannot be an officer/director/employee of an alcoholic beverage licensee. If winner chooses not to take a guest, then the guest elements will be forfeited and the remaining elements shall constitute full satisfaction of the prize. Other travel/accommodation restrictions may apply. Trip must be taken on dates designated by Sponsor or prize will be forfeited in its entirety and may be awarded to the next runner-up. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of Napa, CA, as determined by Sponsor in its sole discretion, and to award no additional compensation in such event. Sponsor is not responsible for travel delays. Finalist Prize winners and their respective guests agree to comply with all event rules and regulations and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner. Failure to do so may result in forfeiture of prize. Finalists must prepare the recipe in the live competition and must be the original persons who entered the recipe. Use of surrogates or proxies is expressly prohibited.
One (1) Grand Prize (Overall best recipe): $25,000 awarded in the form of a check.
One (1) Second Place Prize: $7,500 awarded in the form of a check.
One (1) Third Place Prize: $2,500 awarded in the form of a check.
One (1) Fourth Place Prize Genesis E320 Weber Grill (Approximate Retail Value (“ARV”) = $699.
Prizes are awarded “as is” without warranty or guarantee either express or implied by Sponsor. Any and all warranties and/or guarantees (if any) shall be subject to the manufacturer’s terms therefore (each winner agrees to look solely to such manufacturer for any such warranty and/or guarantee, if any). No transfer, assignment, cash redemption or substitution of prizes (or portion of prize) except by Sponsor due to prize unavailability and then for a prize (or applicable portion of prize) of comparable or greater value as determined by Sponsor, unless otherwise provided herein. Total ARV of all prizes: $91,699.
Miscellaneous: All costs, including federal, state and local taxes and other expenses not specifically identified, including, but not limited to, additional meals, gratuities, service charges or taxes, additional ground transportation, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, hotel room local and long distance telephone calls and all other unspecified incidental expenses, are the sole responsibility of the Finalists and respective Prize winners. Finalist Prize traveling companions will be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents. Non-compliance with the foregoing may result in disqualification. By participating, each entrant warrants and represents that his/her recipe does not violate any federal, state or local laws or ordinances. Entrants further warrant and represent that (1) Sponsor & its designees shall own the recipes (and all material embodied therein); (2) that by entering, the entrant irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the recipe including but not limited to all intellectual property rights; and (3) that Sponsor and its designees shall have, without limitation, the perpetual, right (but not obligated) worldwide to edit, adapt, modify, publish, exploit and use the recipe in any way and in any media for trade, advertising, promotional and/or other purposes as Sponsor and/or its designees may determine without further consideration, notification or permission of entrants, winners or any third parties. Entrants further agree that (1) they agree to be bound by these Official Rules and the decisions of the Sponsor and judges which are final and binding in all respects; (2) recipe entries (and all components thereof) will not be acknowledged; (3) Released Parties and their designees shall have the right and permission to use (unless prohibited by law) entrant’s name, voice, city and state of residence, photograph and/or likeness for advertising and/or trade and/or any other purpose in any media now or hereafter known without further compensation, permission or notification to entrants or any third parties; and (4) the Released Parties shall have no liability and will be held harmless by entrants for any liability, loss, injury or damage to participants or any other person or entity, including personal injury or death to participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of entrant’s participation in this Contest, the use of any recipe or acceptance, possession, use or misuse of a prize (including any travel/activity related thereto or harm/injury caused from the use of rental vehicle or grill during live competition). Sponsor reserves the right, in its sole discretion, to void suspect entries or to modify, cancel, terminate or suspend the Contest (or any portion thereof) should virus, worms, bugs, non-authorized human intervention or other causes, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of the promotion and, in the event of such cancellation, suspension or termination, at its discretion, as applicable, select entries to qualify for judging from all non-suspect, eligible recipes received prior to event requiring cancellation, termination or suspension.
Sponsor reserves the right to conduct a background check of any and all records of the Finalist Prize winners, including without limitation, civil and criminal court records and police reports. To the extent necessary under law, Finalist Prize winners shall authorize this background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by Finalist Prize winners in his/her interview. In that regard, Finalist Prize winners will be obligated to provide necessary contacts and information so that Sponsor may conduct such investigation. Sponsor reserves the right (at its sole discretion) to disqualify Finalist Prize winners from any prize element, based on the background check.
Disputes/Choice of Law: Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed by California law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Contest or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in Napa County, California, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Privacy: Personally identifiable information that is submitted by entrants as part of this Contest will be used to administer the Contest, select prize winners and fulfill prizes, and will be treated in accordance with Sponsor’s privacy policy accessible on its website at www.GreatSteakChallenge.com.
